first_imgWarren Haynes and Gov’t Mule are back in Asheville, North Carolina this weekend for the 30th edition of the prolific guitarist’s annual star-studded Christmas Jam. This year’s weekend event got moving with a pre-jam concert at the Orange Peel on Thursday night, which included notable appearances from Jimmy Vivino to Marco Benevento. Friday evening saw Haynes and other scheduled performers including Grace Potter, Jamey Johnson, Benevento, and Mike Gordon all move over to the larger U.S. Cellular Center to begin the main event. It was there on Friday where Gov’t Mule once again transformed into their Pink Floyd-themed Dark Side of the Mule, which sw Warren and his bandmates spend the entire set covering the famous psychedelic rock pioneers.The show began with “Pigs On The Wing Pt. I” from Pink Floyd’s 1977 Animals LP, which included a wonderfully hazy ending solo from Haynes. From there, they transitioned into a pair of tunes from 1975’s Wish You Were Here with “Shine On You Crazy Diamond Part I” and “Have A Cigar”. Next, they moved into the sound effects-driven “Speak To Me” from their psychedelic masterpiece The Dark Side of the Moon, which of course went right into the album’s dreamy “Breathe (In The Air)”, “On The Run”, “Time”, “The Great Gig in the Sky”, and “Money”. From there, the band moved into climactic Dark Side ballad “Us And Them”, which saw them welcome My Morning Jacket‘s Jim James to the stage to help out on vocal duties.Dark Side of the Mule with Jim James – “Us And Them” – 12/7/2018[Video: Gregory Marcus]The night continued with “Any Colour You Like” before the band took a break from Dark Side and transitioned into an eerily fun rendition of “Welcome To The Machine”. The band would finally return to the stage for a one-song encore of “Wish You Were Here”. A sheriff’s SWAT team was sent to the scene to assist Alhambra police, he added. In this case, the appellant was a landowner in Columbiana who lived in an area zoned residential and kept hens in a chicken coop on his property. The appellant was eventually informed that keeping his hens was in violation of the city code. A lawsuit resulted when the landowner would not remove his chickens, and the trial court found for the city. The landowner appealed the trial court’s decision, arguing that he did not violate the city ordinances as they were written, and that the city applied the ordinances in an arbitrary and unreasonable way because his chickens did not constitute a nuisance. Although keeping chickens is not explicitly outlawed in Columbiana, the Court of Appeals for Ohio’s Seventh District found that reading the city’s zoning ordinances all together, the “prohibition on agricultural uses within residential districts can be inferred.” Furthermore, the court pointed out that the city’s code did not ban chickens in the whole city, but instead limited them to agricultural districts, and that the prohibition in residential areas was meant to ensure public health. For these reasons, the court found that the ordinances were not arbitrarily and unreasonably applied to the appellant, and as a result, the ordinances are constitutional. The latest in a daisy chain of top executives, Whitman was charged with turning the company around after years of stagnation. More and more, her efforts look like someone tirelessly bailing water out of a leaky boat. Only the ship keeps taking more water.HP’s stock price is down 29% this year while the Nasdaq has rallied 21% and its rivals IBM and Oracle are up 12% and 27%, respectively. The company’s decline has persisted as earnings report after earnings report showed that turning things around would be much harder than most investors – and perhaps Ms. Whitman – expected.The challenges facing HP are in several areas. The IT services that the company has been looking to for high growth is suffering through a hard year thanks to the weak economy in Europe. As we’ve noted, the printer business is slowing dramatically as people store photos on their smartphones. And revenue at its PC business – an albatross around the company’s neck since it bought Compaq – is plummeting 9% a year, while operating earnings in the division are down 21%.On top of that, HP had to take a $8 billion writedown related to its $13.9 billion acquisition of EDS. The financial charge caused HP to swing to a net loss of $8.8 billion from a profit of $2.5 billion a year earlier. Meanwhile, HP was having mixed results integrating another big acquisition – the $11.7 bllion paid for UK software firm Autonomy a year ago – into its operations.Since then, the bad news has only continued. One Wall Street analyst said he was bracing for the worst July-December period in the history of the PC industry, thanks to confusion over the release of Windows 8. HP had been looking for a boost to its high-end desktop PCs with the Spectre One, but initial raves by some gadget blogs were derailed by charges that the Spectre One copied the look of Apple’s iMacs.More serious for HP’s future was news that GM will hire 10,000 IT workers in an effort to bring its operations in-house. GM, a longtime client of EDS, had signed with HP a $600 million-a-year contract that now seems in jeopardy. On Monday, HP noted in a filing to the SEC it would cut 2,000 more jobs than the 27,000 it announced in May.Investors bearish on HP have long charged that the company masked slow growth with a series of high-profile and high-priced acquisitions starting with Compaq in 2001 and through Autonomy last year. Whitman’s effort to turn around HP has been complicated by a decade of M&A deals that saddled the company with a declining business (Compaq), a huge writedown (EDS) and a clumsy integration process (Autonomy).Once she works through those problems, Whitman may have a IT giant capable of competing with Oracle, IBM and others for large corporate contracts. HP’s turnaround would have been tough under the best of circumstances. But with so many big competitors in a sluggish global economy, HP’s rotten week is a stark reminder that it’s swimming against the tide.HP’s stock traded at $22 a share in June, but last month fell to $16 a share – its lowest level in 8 years. News of the layoffs has lifted its stock since that low, but HP’s market value of $36 billion is still a fraction of Oracle’s $160 billion and IBM’s $235 billion. first_imgMIRABEL, Que. — The Canadian government says it is planning to sell back the last remaining unused land it expropriated in 1969 for construction of the Mirabel airport.Federal Transport Minister Marc Garneau said today Ottawa will offer the roughly 300 hectares of land for sale to its original owners or their descendants.About 38,800 hectares of farmland were expropriated by Ottawa in the 1960s to make way for the ill-fated airport project. The Mirabel airport never caught on with passengers, and its terminal was demolished in 2014. It now serves only cargo airlines.Ottawa had sold back 32,000 hectares in the 1980s, and in 2006 it began returning what remained outside the airport zone. But it excluded 300 hectares that were inaccessible by road.That obstacle was removed in 2016 when Ottawa and the city of Mirabel reached an agreement to open up the last bit of territory.The government of Pierre Elliott Trudeau wanted to turn the Mirabel airport into the main hub of airline travel for the Montreal region, but that vision never came to be. About 3,000 families were affected by the expropriations in the 1960s.Today’s announcement ends the long-running dispute over expropriated lands outside the airport zone.
